Terms and Conditions – webteam4u.eu

These terms apply to all services and offers from webteam4u, based in Spain and registered as a freelancer. By entering into a collaboration, the client agree to these conditions.
1. Definitions
- Webteam4u: the contractor, based in Spain, operating as an independent web designer and content creator.
- Client: any natural or legal person who commissions a project from webteam4u.eu.
- Agreement: the arrangements between Webteam4u and the client, confirmed in writing or by email.
2. Applicability
- These conditions apply to every collaboration, unless otherwise agreed in writing.
- Any general terms and conditions from the client are explicitly excluded.
3. Quotes and pricing
- Quotes are non-binding and valid for 30 days after the date of issue.
- All prices are exclusive of VAT and any additional costs, such as licenses or third-party services.
- For additional work, changes or urgent requests, an adjusted or higher rate may apply. The base hourly rate for additional work is stated in the quotation.
4. Project execution
- Webteam4u carries out assignments to the best of its ability and expertise, but cannot guarantee specific results.
- Delivery times are indicative unless agreed otherwise.
- Webteam4u may collaborate with third parties for complex projects, such as copywriters or developers.
5. Client responsibilities
- The client must provide all necessary information and materials on time.
- Delays or incomplete input may affect the timeline or result in additional costs.
6. Payment
- Invoices must be paid within fourteen days of the invoice date.
- If payment is delayed, Webteam4u may charge additional fees and pause the work.
- For larger projects, invoicing is typically done in phases, for example at the start, mid-project and upon delivery.
- If the final delivery is delayed due to missing input or feedback, while most of the work has been completed, Webteam4u reserves the right to send the final invoice, in full or in part.
7. Hosting and email services
- If the client purchases hosting and/or email services via Webteam4u, these services are technically provided by an external hosting provider, namely WSonline.
- Webteam4u acts as a reseller and point of contact for the client. The technical infrastructure, servers and related services are the responsibility of WSonline and its hosting providers.
- The general terms and conditions of WSonline additionally apply to hosting and email services. These terms are available upon request.
- Webteam4u is not responsible for outages, downtime, data loss or other technical issues arising from hosting or email services, unless there is intent or gross negligence on the part of Webteam4u.
8. Cancellation and termination
- The client may terminate the collaboration at any time, subject to a notice period of fourteen days.
- Any work already carried out will be invoiced on a pro rata basis.
9. Intellectual property
- All work created by Webteam4u remains the property of Webteam4u until full payment has been received.
- After payment, the client receives a non-exclusive right of use, unless agreed otherwise.
- Webteam4u retains the right to showcase the work in its portfolio, presentations or on social media, unless agreed otherwise in advance.
10. Force majeure
- Webteam4u is not obliged to fulfil its obligations if this is reasonably impossible due to circumstances beyond its control.
- Force majeure includes, but is not limited to, illness, temporary incapacity, technical failures, network issues, server outages or failures of third-party services, including hosting providers.
- In the event of force majeure, obligations will be suspended for the duration of the situation, without any right to compensation.
11. Liability
- Webteam4u is not liable for indirect or consequential damage.
- Any liability for direct damage is limited to the invoice amount of the relevant assignment.
- Webteam4u is not liable for loss of email, data or files as a result of technical issues with hosting or email services, or due to incorrect use or settings on the part of the client.
12. Confidentiality
- All information shared by the client remains confidential, including data, strategies and internal documents.
- Designs created for the client may be used as examples in the portfolio of Webteam4u.
13. Applicable law
- These terms and conditions are governed by Spanish law.
- Any disputes shall be submitted to the competent court in Spain, without prejudice to mandatory consumer rights applicable in the client’s country of residence.
